
Garnishment - also called Administrative Wage Garnishment (AWG) - is the withholding of a portion of an individual’s paycheck by his/her employer to be applied to a debt owed by the individual. The amount withheld from the paycheck is sent by the employer to the employee’s creditor to be applied to the outstanding debt.

One of the ways OGSLP collects payment on defaulted loans is through AWG, which allows garnishment without a court order. A Federal Statute (20 USC 1095a et. seq.) allows OGSLP to garnish 15 percent of a defaulted borrower’s disposable pay until the debt is paid in full. Disposable pay is the portion of a paycheck remaining after the deductions required by law are withheld.
A minimum of 30 days before any garnishment, notification is sent to the borrower of the agency’s intention to garnish wages. The borrower is given an opportunity to review OGSLP’s records relating to the debt, to resolve the debt voluntarily and to have a hearing concerning the debt.
